This privacy policy (“Privacy Policy”) governs how we, Powerlead Inc. (together, “Powerlead” “we”, “our” or “us”) use, collect and store Personal Data we collect or receive from or about you (“you”) in connection with https://powerlead.com (the "Website") and/or Powerlead platform (the "Platform") and the services provided therein (the “Services”).

Powerlead is a business intelligence platform through which customers (who are businesses) that use it (“Customer(s)”) can obtain information (which could contain Personal Information) to assist them in marketing to potential prospects and others who may be interested in their products or their business-to-business sales, marketing, and recruitment activities. Powerlead collects information of companies, businesses and their employees from multiple sources (including, publicly available sources, partners, community, etc). By remaining in our database, you may be contacted by our Customers when they are conducting their sales and marketing activities. Communications you receive from our Customers may be relevant to your profession or employment role, but we cannot guarantee that you will find such communications to be relevant or of interest to you. You can opt out of our database by submitted your request here https://powerlead.com/opt-out. You can submit an access request and update your profile information. This Privacy Policy can be updated from time to time and, therefore, we ask you to check back periodically for the latest version of this Privacy Policy. If we implement significant changes to the use of your Personal Data in a manner different from that stated at the time of collection, we will notify you by posting a notice on our Website and/or Services or by other means and take any additional steps as required by applicable law.

  1. WHAT INFORMATION WE COLLECT, WHY WE COLLECT IT, AND HOW IT IS USED

    (i) We Process the Following Personal Information:

    1. Information provided through the Website. When you use the Website, we collect and process full name, email address, phone number, company details when you interact with the Website, for example, when you send us a request for a demo or contact us.
    2. Information that you provide us through the Platform.
      1. We collect Personal Information that you voluntarily provide, such as your registration details, full name, email address, username and password, job title and department, phone number, company name, postal address of company and business-related postal address of the person, as well as any other information that you decide to provide us. We also collect the contact and billing information of our Customers.
      2. When you register to our Platform, we collect your payment information and details.
      3. When you make use of the Platform, you may send us some information to provide you the output results for example name, email address or company name.
    3. Information automatically collected. We automatically collect certain information through your use of Powerlead's Website and Platform such as cookie, pixels, tracking technologies and similar identifiers(“Technologies”), your Internet protocol (IP) address, and other device identifiers that are automatically assigned to your device, browser type and language, geo-location information, hardware type, operating system, internet service provider and other information about actions taken through the use of the Services, and the Platform.
    4. Information from Other Sources. Powerlead also obtain information about you from other sources, including publicly - or commercially- available information, and through third-party data platforms, partners and service providers.
    5. Information we collect from online interactions. For example, if you attend a webinar, contact us via social media or otherwise interact with our business, including as a representative of a current / prospective customer, supplier or partner, we track and make a record of those interactions, which may contain your contact details, such as full name, email address, messages and any other information that you decide to provide us with.

    (ii) We process information for the following purposes:

    1. To allow you to make use of our Website. We will use your Personal Information to allow you to make use of our Website, including, (i) if you request a demo, we will use your Personal Information to process and answer your request for a demo; (ii) to answer your questions and to allow you to communicate with us; (iii) to analyze your use of our Website and to improve our Website; and (iv) to customize your experience.
    2. To provide you with the Services. We will use your Personal Information, including, without limitation, for the following purposes: (i) allow you to create an account; (ii) to provide you the Services and to process your requests; (iii) communicate with you about your use of the Services, to provide you the output and for support purposes; (iv) fulfill any instruction and/or request made by you in the context of the Services; (v) send you push notifications and/or emails and notifications regarding your account or certain features of the Services, including, updates pertaining to your subscription, and related to the services we provide you with; (vi) to personalize your experience with our Services; (vii) to to generally administer and improve the Services; and (viii)
    3. For Administrative Purposes. Powerlead use your information (i) to respond to your questions, comments, and other requests for Customer support, to access, correct, or delete their information, or requests to exercise other rights related to their information under applicable law or information, including information about potential or future services; (ii) to provide you with the Powerlead Services; (iii) for internal quality control purposes; (iv) to establish a business relationship; (v) to generally administer the Powerlead Services; and (vi)
    4. To Market our Services. Powerlead use information to market Powerlead Services. Such use includes (i) notifying you about offers and services that may be of interest to you; (ii) tailoring content, advertisements, and offers for you, including, targeting and re-targeting practices; (iii) conducting market research; (iv) developing and marketing new products and services, and to measure interest in Powerlead's services; (v) other purposes disclosed at the time you provide information; (vi) as you otherwise consent; and (vii)
    5. Security purposes. Some of the abovementioned Personal Information will be used for detecting, taking steps to prevent and prosecuting fraud or other illegal activity; to identify and repair errors; to conduct audits; and for security purposes. Information may also be used to comply with applicable laws, with investigations performed by the relevant authorities, law enforcement purposes, and/or to exercise or defend legal claims.
    6. De-identified and Aggregated Information Use. In certain cases, we may or will anonymize or de-identify your Personal Information and further use it for internal and external purposes, including, without limitation, to analyze and improve Powerlead Services (including through the use of artificial intelligence) and for research, benchmark and other purposes. “Anonymous Information” means information which does not enable identification of an individual user, such as aggregated information about the use of our services. We may use this anonymous or de-identified information and/or disclose it to third parties without restrictions (for example, in order to improve our Services and enhance your experience with them and/or to develop new product features and improve existing offerings).
    7. To post Customer testimonials on our Platform. We may post Customer testimonials on our Services which may contain the Customer’s name and other details. We obtain consent from the Customer prior to posting any testimonial. If a Customer wishes to update or delete their testimonial, they can contact us at support@powerlead.com.
    8. Blogs or community forums. Our Services offer publicly accessible blogs or community forums. Any content provided in these areas may be read, collected, and used by others who access them. Individuals can request the removal of their Personal Information from our blog or community forum by contacting us at support@powerlead.com. In some cases, we may not be able to remove the Personal Information, in which case we will let the requestor know that we are unable to do so and why.

    (iii) The lawful bases we rely on for processing personal information are (if and when applicable):

    1. The data subject has given consent to the processing of his or her personal data;
    2. Processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract;
    3. processing is necessary for compliance with a legal obligation to which the controller is subject; and/or
    4. Processing is necessary for the purposes of the legitimate interest.

  2. POWERLEAD AS A DATA PROCESSOR.

    • For the avoidance of doubt, Powerlead is processing Customer Information on behalf of the applicable Customer. Therefore, the Customer is responsible party for the security, integrity and authorized usage of Customer Information in the context of the services and also for obtaining consents, permissions and providing any required data subject rights and fair processing notices required for the collection and usage of such Customer Information.
    • Powerlead has a contractual relationship with its Customers. In the context of Powerlead’s services, the Customer can upload and input to the platform (at the Customer’s sole discretion) information, including Personal Data (“Customer Information”). In such cases, Powerlead is acting as the data processor, and receives Customer Information as agent and/or service provider of the Customer. Powerlead follows the Customer’s instructions when processing Customer Information. The Customer is solely responsible and liable for determining whether and how the Customer would like to use Powerlead’s platform, and for ensuring that the Customer provides with adequate notice regarding the processing of the Customer Information, obtained relevant consents or authorization, and that all legal requirements applicable to the collection, use, or other processing of Customer Information through Powerlead’s services have been met by such Customers.
    • Customer Information is not regulated by this privacy policy, and this paragraph is provided only for transparency purposes. If you have any questions related to the Customer Information, please contact the Customer directly.
    • Please note that in certain circumstances, Powerlead may act as an independent controller of the Customer Information, when the Customer provides such authorization.

  3. HOW WE PROTECT AND RETAIN YOUR INFORMATION

    • Security. We have implemented and maintain appropriate technical, organizational and security measures designed to protect your Personal Data. However, please note that we cannot guarantee that the information will not be compromised as a result of unauthorized penetration to our servers. In the unlikely event there is a loss or corruption of Personal Data, Powerlead is not responsible or liable for such loss or corruption. As the security of information depends in part on the security of the computer, device or network you use to communicate with us and the security you use to protect your user IDs and passwords, please make sure to take appropriate measures to protect this information. We encourage our users to retain copies of all uploaded information on their own system.
    • Retention of your Personal Data. Your Personal Data will be stored until we delete the record and we proactively delete it or you send a valid deletion request, please note that in some circumstances we may store your Personal Data for longer periods of time, for example (i) where we are required to do so in accordance with legal, regulatory, tax or accounting requirements, or (ii) for us to have an accurate record of your dealings with us in the event of any complaints or challenges, or (iii) if we reasonably believe there is a prospect of litigation relating to your Personal Data or dealings. Where we are unable to do so, we will ensure that appropriate measures are put in place to prevent any further use of such information. We have an internal data retention policy to ensure that we do not retain your Personal Data perpetually. Retention periods will be determined taking into account the amount, nature, and sensitivity of the personal information and the purpose(s) for which it was collected.   4. HOW WE SHARE YOUR PERSONAL DATA

    In addition to the recipients described above, we may share your Personal Data as follows:

    • With our business partners with whom we jointly offer products or services. We may also share Personal Data with our affiliated companies.
    • With our Customers, to provide them our services.
    • We may use third party service providers to process your Personal Information for the purposes outlined above, including, without limitation:
      • With cloud service providers for hosting purposes;
      • With websites and web content creation platforms in order to help us manage our Services;
      • With email providers, marketing, CRM, other similar tool providers;
      • With analytic companies, in order to help us understand and analyze information we collect in accordance with this policy; and
    • To the extent necessary, with regulators, courts or competent authorities, to comply with applicable laws, regulations and rules (including, without limitation, federal, state or local laws), and requests of law enforcement, regulatory and other governmental agencies or if required to do so by court order;
    • If, in the future, we sell or transfer, or we consider selling or transferring, some or all of our business, shares or assets to a third party, we will disclose your Personal Data to such third party (whether actual or potential) in connection with the foregoing events;
    • In the event that we are acquired by, or merged with, a third party entity, or in the event of bankruptcy or a comparable event, we reserve the right to transfer, disclose or assign your Personal Data in connection with the foregoing events, including, in connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or to another company; and/or
    • Where you have provided your consent to us sharing or transferring your Personal Data (e.g., where you provide us with marketing consents or opt-in to optional additional services or functionality).

  5. INFORMATION REGARDING TRANSFERS OF PERSONAL DATA

    In order to run our business and provide our Services to you, we transfer Personal Information to certain countries around the world, including to our affiliates and service providers, many of whom are located outside of your jurisdiction. Therefore, your Personal Information may be processed in countries with privacy laws that are different from privacy laws in your country. Whenever we make such transfers, we will use commercially reasonable efforts to implement an appropriate level of protection to your Personal Information by implementing at least one of the following safeguards:

    1. making sure the destination country has been deemed to provide an adequate level of protection for Personal Data; and/or
    2. by executing implement data onward transfer instruments such as data processing and protection agreements.

  6. YOUR PRIVACY RIGHTS. HOW TO DELETE YOUR ACCOUNT
    • Rights: The following rights (which may be subject to certain exemptions or derogations) shall apply to certain individuals (some of which only apply to individuals protected by the GDPR):

      • You have a right to access Personal Data held about you. Your right of access may normally be exercised free of charge, however we reserve the right to charge an appropriate administrative fee where permitted by applicable law;
      • You have the right to request that we rectify any Personal Data we hold that is inaccurate or misleading;
      • You have the right to request the erasure/deletion of your Personal Data (e.g. from our records). Please note that there may be circumstances in which we are required to retain your Personal Data, for example for the establishment, exercise or defense of legal claims; You have the right to object, to or to request restriction, of the processing;
      • You have the right to data portability. This means that you may have the right to receive your Personal Data in a structured, commonly used and machine-readable format, and that you have the right to transmit that data to another controller;
      • You have the right to object to profiling;
      • You have the right to withdraw your consent at any time. Please note that there may be circumstances in which we are entitled to continue processing your data, in particular if the processing is required to meet our legal and regulatory obligations. Also, please note that the withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal;
      • You also have a right to request certain details of the basis on which your Personal Data is transferred outside the European Economic Area, but data transfer agreements and/or other details may need to be partially redacted for reasons of commercial confidentiality;
      • You have a right to lodge a complaint with your local data protection supervisory authority (i.e., your place of habitual residence, place or work or place of alleged infringement) at any time or before the relevant institutions in your place of residence. We ask that you please attempt to resolve any issues with us before you contact your local supervisory authority and/or relevant institution.
    • The following rights (which may be subject to certain exemptions or derogations) shall apply to individuals protected by the CCPA:

      • You have the right to know what Personal Information is being collected about you, This include the right to request that we disclose what Personal Information of yours we collect, use, disclose, and sell;
      • You have the right to request the erasure/deletion of your Personal Information (e.g. from our records and the records of our service providers). Please note that there may be circumstances in which we are required to retain your Personal Information, for example for the establishment, exercise or defense of legal claims;
      • You have the right to know whether your Personal Information is sold or disclosed and to whom;
      • You have the right to restriction of, or object to, processing of your Personal Information, including the right to opt in or opt out of sale of your Personal Information to third parties, if applicable, where such requests are permitted by law;
      • You have the right not to receive discriminatory treatment for the exercise of the privacy rights conferred by the CCPA;
      • You have a right to lodge a complaint with your local data protection supervisory authority (i.e., your place of habitual residence, place or work or place of alleged infringement) at any time or before the relevant institutions in your place of residence (e.g. the Attorney General in your State). We ask that you please attempt to resolve any issues with us before you contact your local supervisory authority and/or relevant institution. You have certain choices about your Personal Information. Where you have consented to the processing of your Personal Information, you may withdraw that consent at any time and prevent further processing by contacting us as described in this Privacy Policy. Even if you opt out, we may still collect and use non-Personal Information regarding your activities on our services and for other legal purposes as described above. While we cannot guarantee privacy perfection, we will address any requests to the best of our ability as soon as possible. We will process such requests in accordance with applicable laws.
    • You can exercise your rights by contacting us at privacy@powerlead.com or, if you are an individual protected by CCPA, you can make your requests by email, by submitting the online form https://powerlead.com/request-my-info. You may use an authorized agent to submit a request on your behalf if you provide the authorized agent written permission signed by you. To protect your privacy, we may take steps to verify your identity before fulfilling your request. Subject to legal and other permissible considerations, we will make every reasonable effort to honor your request promptly in accordance with applicable law or inform you if we require further information in order to fulfil your request. When processing your request, we may ask you for additional information to confirm or verify your identity and for security purposes, before processing and/or honoring your request. We reserve the right to charge a fee where permitted by law, for instance if your request is manifestly unfounded or excessive. In the event that your request would adversely affect the rights and freedoms of others (for example, would impact the duty of confidentiality we owe to others) or if we are legally entitled to deal with your request in a different way than initial requested, we will address your request to the maximum extent possible, all in accordance with applicable law.
    • Deleting your account: Should you ever decide to delete your account, you may do so by emailing support@powerlead.com. If you terminate your account, any association between your account and Personal Data we store will no longer be accessible through your account. However, given the nature of sharing on certain services, any public activity on your account prior to deletion will remain stored on our servers and will remain accessible to the public.
    • Marketing emails: You may choose not to receive marketing email of this type by sending a single email with the subject "BLOCK" to support@powerlead.com. Please note that the email must come from the email account you wish to block or if you receive an unwanted email from us, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future emails, and we will process your request within a reasonable time after receipt.

  7. USE BY CHILDREN. We do not offer our products or services for use by children and, therefore, we do not knowingly collect Personal Data from, and/or about children under the age of eighteen (18). If you are under the age of eighteen (18), do not provide any Personal Data to us without involvement of a parent or a guardian. For the purposes of the GDPR, we do not intend to offer information society services directly to children. In the event that we become aware that you provide Personal Data in violation of applicable privacy laws, we reserve the right to delete it.   8. INTERACTION WITH THIRD PARTY PRODUCTS. We enable you to interact with third party websites, mobile software applications and products or services that are not owned or controlled by us (each a “Third Party Service”). We are not responsible for the privacy practices or the content of such Third Party Services. Please be aware that Third Party Services can collect Personal Data from you. Accordingly, we encourage you to read the terms and conditions and privacy policies of each Third Party Service.

  9. ANALYTIC TOOLS

    • Google Analytics. The Website uses a tool called “Google Analytics” to collect information about use of the Website. Google Analytics collects information such as how often users visit this Website, what pages they visit when they do so, and what other websites they used prior to coming to this Website. We use the information we get from Google Analytics to maintain and improve the Website and our products. We do not combine the information collected through the use of Google Analytics with Personal Information we collect. Google’s ability to use and share information collected by Google Analytics about your visits to this Website is restricted by the Google Analytics Terms of Service, available at https://marketingplatform.google.com/about/analytics/terms/us/, and the Google Privacy Policy, available at http://www.google.com/policies/privacy/.     • We use log files. We use such information to analyze trends, administer the Website, track users’ movement around the Website, and gather demographic information.
